4. Site content
We try to keep the Site accurate and current, but insurance products, rules, and prices change. Coverage descriptions on the Site are summaries only; the policy itself controls. We may change or remove content at any time.
Legal
These Terms include an arbitration agreement that requires most disputes to be resolved by individual arbitration instead of in court, and a waiver of class actions and jury trials. You can opt out of arbitration within 30 days.
These Terms of Use ("Terms") are an agreement between you and Yellow Ribbon Insurance LLC ("Yellow Ribbon," "we," "us"). They apply to yellowribboninsurance.com (the "Site") and to the forms, calls, and messages connected to it. By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old to submit a form.
Yellow Ribbon is an insurance agency licensed in Indiana and Kentucky. We offer insurance only to residents of, and for property located in, the states where we are licensed. The Site provides general information about insurance; it is not legal, tax, or financial advice.
Using the Site does not bind coverage. Submitting a form, receiving a quote, or talking with us does not create an insurance policy or put coverage in force. Coverage begins only when an insurance company accepts your application and issues a policy or written binder, and your coverage is governed solely by the terms of that policy.
Any price, savings figure, or discount shown on the Site or given to you before a policy is issued is an estimate. Final premiums depend on the insurance company's underwriting, the information you provide, consumer reports it may obtain (such as driving records, claims history, or insurance scores), available discounts, and eligibility. Savings are not guaranteed and vary by person.
We try to keep the Site accurate and current, but insurance products, rules, and prices change. Coverage descriptions on the Site are summaries only; the policy itself controls. We may change or remove content at any time.
You agree that the information you submit is true, accurate, and your own (or that you are authorized to provide it), and that the phone number you enter is yours or one you are authorized to use. Giving false or incomplete information to an insurance company can affect your coverage or claims. We handle what you submit as described in our Privacy Policy.
When you submit a form that shows our consent disclosure, you give Yellow Ribbon Insurance LLC your prior express written consent, by electronic signature, to call and text you at the number you provided about your insurance quote and related insurance products and services, including calls and texts made with automated technology or an artificial or prerecorded voice, even if your number is on a federal or state Do Not Call list.
You agree that clicking a button such as "Get My Quote" or "Get My Free Quote" next to our disclosure is your electronic signature and has the same effect as signing on paper, under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act as adopted in Indiana and Kentucky. You also agree that we may provide disclosures, notices, and records about your quote request electronically.
You agree not to: submit another person's information without permission; submit false, fraudulent, or automated requests; interfere with the Site's security or operation; scrape, copy, or harvest data from the Site; attempt to access systems or data you are not authorized to access; or use the Site for any unlawful purpose.
The Site's text, design, graphics, and logos belong to Yellow Ribbon Insurance LLC or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use. Insurance company names and marks belong to their owners.
The Site links to and uses services we do not control, including insurance company account portals, maps, and social media. We are not responsible for their content, availability, or privacy practices, and your use of them is governed by their own terms.
The Site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the Site will be uninterrupted or error-free.
To the fullest extent the law allows, Yellow Ribbon will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, and our total liability for any claim arising from your use of the Site is limited to one hundred dollars ($100).
These limits apply only to your use of the Site. They do not limit any right you have under an insurance policy, under Indiana or Kentucky insurance law, or under any law that cannot be waived by agreement, and they do not limit our professional responsibilities as a licensed insurance agency.
Try to resolve it informally first. Before starting arbitration or a lawsuit, you and we agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for 30 days. Send notices to us at Yellow Ribbon Insurance LLC, 3211 Grant Line Rd Ste 7, New Albany, IN 47150. All statutes of limitations and filing-fee deadlines are tolled (paused) while the parties engage in this informal process.
Binding individual arbitration. If the dispute is not resolved within 30 days, any claim arising out of or relating to the Site, these Terms, or the calls, texts, or emails we send you (including claims under the Telephone Consumer Protection Act) will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time. The arbitrator decides all questions about the scope and enforceability of this agreement, except that a court decides questions about the class-action waiver and the mass-arbitration provisions. The Federal Arbitration Act governs this section. Hearings may be held by video or phone, or in the county where you live. If the AAA declines or is unable to administer an arbitration, the claim may proceed in small claims court or in the courts named in section 13.
Costs. We will pay all AAA filing, administration, and arbitrator fees for any arbitration you start, unless the arbitrator finds your claim frivolous or brought for an improper purpose. Each side pays its own attorneys' fees unless the law or the arbitrator's award provides otherwise.
Class action and jury trial waiver. You and we each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may award relief only to the individual party and only to the extent needed for that party's individual claim. You and we each waive the right to a jury trial.
Mass Arbitration. If 25 or more similar claims are filed against us by or with the help of the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules (including their procedures for administering claims in batches) apply to those claims. The statute of limitations for each such claim remains tolled while it awaits administration under those rules. This provision does not prevent any claimant from pursuing an individual claim in small claims court.
Exceptions. Either of us may bring an individual claim in small claims court (for example, Floyd County, Indiana) if it qualifies. Nothing in these Terms prevents you from filing a complaint with, or seeking relief through, the Indiana Department of Insurance, the Kentucky Department of Insurance, the Federal Communications Commission, the Federal Trade Commission, or a state attorney general.
30-day right to opt out. You may opt out of this arbitration agreement within 30 days after you first submit a form on the Site by mailing a letter to Yellow Ribbon Insurance LLC, 3211 Grant Line Rd Ste 7, New Albany, IN 47150 (postmarked within the 30 days), or by calling (812) 577-8749 and asking to opt out of arbitration; we will confirm phone opt-outs in writing. Include your name, address, phone number, and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules, and by federal law where it applies. If a dispute is not subject to arbitration, or you opt out, it will be brought only in the state or federal courts serving Floyd County, Indiana, and you and we consent to their jurisdiction. If you live in Kentucky, you may instead bring an individual claim in the courts of the county where you live.
These Terms and our Privacy Policy are the entire agreement about your use of the Site. If any part is found unenforceable, the rest stays in effect, except that if the class-action waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration. Our failure to enforce a provision is not a waiver. We may update these Terms by posting a new version with a new effective date; changes do not apply to disputes you have already told us about in writing, and material changes to the arbitration section will not apply to claims that arose before the change. Questions? Call (812) 577-8749 or write to Yellow Ribbon Insurance LLC, 3211 Grant Line Rd Ste 7, New Albany, IN 47150.
